Conveyancing is one area of Jersey law in which legal advice should be obtained. Jersey property can be held by ownership of shares in a company which itself owns property, by freehold, by flying freehold or by leasehold. Jersey property may be owned by a company, by an individual, by more than one person (as either joint tenants or tenants in common) but cannot be owned, directly by a trust. The English principle of registered land does not apply to Jersey. It is for this very reason that legal advice should be obtained on all property transactions. Contracts for the sale and purchase of Real Property in Jersey are drafted in the French language. The use of the French language is as a result of Jersey’s heritage and links with mainland France. The use of French Language in Contracts for Jersey Property is to change very shortly and the English language will be used in its place. These property transactions are carried out before the Royal Court of the Island of Jersey.
