The Petty Debts Court
The jurisdiction of the Petty Debts Court has recently increased and can now deal with claims of up to £10,000.00. Originally, the Petty Debts Court could only hear claims for simple debts. Following a relatively recent change to the law, the Petty Debts Court now has jurisdiction to hear all types of claims up to the maximum limit.

While many claims are admitted by defendants and a judgment obtained against them, other cases may have to proceed to trial. Recently, the Petty Debts Court has introduced a system of mediation which is a free service aimed at resolving disputes without the need for a trial. This is sometimes a quicker and cheaper route to resolving disputes for which legal costs may often exceed the amount in dispute.

Currently, the Petty Debts Court of Jersey sits every Wednesday morning at 10.00am. The Royal Court
All claims in excess of the jurisdiction of the Petty Debts Court must be brought in the Royal Court.

In many cases, proceedings issued against debtors are undefended. In such cases the Court simply grants our Advocates judgment on our clients’ behalf. We will then arrange or advise on how this judgment can be enforced against the debtor.

In cases where the defendant denies owing the amount claimed (or part of it) our Litigation Team will pursue the claim to trial on clients’ behalf. |
