Property law in Jersey can be complex. Leases of property under 9 years in duration can be created by a “paper lease”. Leases in excess of 9 years duration are called “contract leases” and must be passed by official contract before the Royal Court. In addition to the complexities of leases, regard must also be had to Jersey’s Housing qualifications. By law, only certain categories of persons are allowed to lease and/or buy property within the Island. This is a complicated area of law on which we would strongly recommend you seek legal advice. Disputes between landlord and tenant often occur. The dispute may arise as a result of a tenant’s failure to pay rent or the result of a tenant damaging the landlord’s property. Equally, disputes arise because of a landlord’s breach of the covenants of the lease. Often, these matters can be resolved without the need to resort to legal proceedings.
